1. INTRODUCTION
1.1. Vino-Say is committed to protecting your privacy. This Privacy Policy tells you about our online collection, use and disclosure of data. The terms of this Policy apply to all data collected by Vino-Say on the App.
1.2. The App is operated and owned by Vino Say (Pty) Ltd (Registration No. 2017/400095/07) (“Vino-Say”) and may be accessed in South Africa and abroad.
1.3. This Policy was last updated during February 2021.
1.4. Vino-Say reserves the right to update this Privacy Policy to reflect changes to our information practices. If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on the App prior to the change becoming effective. We encourage you to review the App periodically for the latest information on our privacy practices. If you do not agree with such changes, do not continue to use the App. Continued use of the App will be deemed to constitute acceptance of the new Privacy Policy.
2. INTERPRETATION
For purposes of this Privacy Policy, the following words and expressions bear the meanings assigned to them:
2.1. “Data” means any data, including Personal Information as defined herein and any other applicable legislation in the jurisdiction where the App is to be accessed, irrespective of the media or form, and specifically includes all data provided by you to us, which are processed and/or stored by us;
2.2. “Privacy Policy/Policy” means this privacy policy;
2.3 “App” means Vino-Say Application (Mobile platform – IOS, Android).
2.4 “Rating” means the feedback or critical appraisal that the App receives from users and which may contribute to the overall rating of the App.
2.5 “User” means the user of the App.
2.6 “Wishlist” means a list of desired products saved by customers to their user account, signifying interest without immediate intent to purchase and which may be viewed by Vino-Say or by other users of the App.
3. DATA COLLECTED
3.1. Vino-Say collects certain kinds of non-personal information, such as the domain that referred you to us, browser type and language, and access times. We also may collect navigational information, including information about the pages you view, the links you click, and other actions taken in connection with the app. Limited demographic information, may also be collected and may be linked to your Personal Information. You hereby consent to the collection of such information.
3.2. We only collect Personal Information about you after you have started to use the App, indicating your acceptance of these terms and have thereby “opted in”.
3.3. Further types of information that may be collected by Vino-Say as well as which may be accessed and viewed by other users of the App include your reviews and ratings of products, as well as information with regards to your Wishlist. You hereby consent to the collection of such information and to the viewing of your reviews, ratings and Wishlist by other users.
3.4. Personal Information includes: 3.4.1. information collected when you register or visit the App including your username and password, name, last name, email address, date of birth and phone number; (“Personal Information”)
3.5. By providing us with Personal Information, you agree to provide accurate and current information, and not to impersonate or misrepresent any person or entity or falsely state or otherwise misrepresent your affiliation with anyone or anything.
3.6. You may always choose not to provide Personal Information, but if you so choose, certain products and services may not be available to you.
4. USE OF PERSONAL INFORMATION
4.1. Vino-Say collects and uses your Personal Information to:
4.1.1. identify you when you sign into your Vino-Say account;
4.1.2. create and manage your Vino-Say account;
4.1.3. provide customer service;
4.1.4. perform research and analysis aimed at improving our products, services and technologies, including sending you surveys;
4.1.5. to display content that is customized to your interests and preferences;
4.1.6. to communicate with you about your transactions, new products and services including transaction-related communications such as welcome letters.
4.1.7. Should you wish to be sent offers and news about our products and services, you will be able to “opt in”. Should you accept these terms, you “opt in” and thereby you consent to our use of your Personal Information for advertising/marketing purposes, including sending you offers and news about our products and services.
4.2. Personal Information collected by Vino-Say will be captured and processed in South Africa and may be stored in South Africa and/or transferred for storage to cloud storage making use of an Internet hosting service, and by providing us with your Personal Information and using our App, you consent to any such transfer of information outside of your country. If you would like to know more about our privacy practices with or if you would like to exercise any of your personal information protection rights (including the right to have your Personal Information deleted), please email support@vino-say.com .
5. DISCLOSING YOUR PERSONAL INFORMATION
5.1. Except as set out in this Privacy Policy, Vino-Say does not disclose or sell your Personal Information to any third parties.
5.2. We may disclose your Personal Information to third party service providers who perform services on our behalf. For example, we may hire other companies to handle the processing of payments, to provide data storage, to host Apps, to fulfil orders and to deliver products purchased, to assist in marketing, to conduct audits, etc. Those third party service providers (i) shall be permitted to obtain only the Personal Information they need to provide the relevant service, (ii) must protect your Personal Information to the same extent as Vino-Say, and (iii) shall be prohibited from using it for any other purpose.
5.3. Personal Information disclosed to Vino-Say may be available to the South African government or its agencies. In the event of a fraudulent online payment, Vino-Say reserves the right to disclose relevant Personal Information for criminal investigation purposes or in line with any other legal obligation for disclosure of the Personal Information which may be required of it.
5.4. Information about you, including Personal Information, may be disclosed as part of any merger, acquisition, or sale of Vino-Say and/or its assets, as well as in the unlikely event of insolvency or bankruptcy, in which case Personal Information would be transferred as one of the business assets of Vino-Say.
5.5. We further reserve the right to disclose your Personal Information to the extent required or permitted by law.
6. CONSENT IN RESPECT OF YOUR PERSONAL INFORMATION
By submitting Personal Information to us, you acknowledge and agree that you have expressly consented to the collection, use and disclosure practices set out in this Privacy Policy as they relate to your Personal Information. 7. ACCESSING YOUR PERSONAL INFORMATION If you would like to review or revise information that you previously provided to us, you may access and change your Personal Information in the "Profile" section of the App. You may also contact Customer Service by email at support@vino-say.com for assistance.
8. USE OF COOKIES AND OTHER TECHNOLOGIES
8.1. Vino-Say do not make use of "cookies" in order to assign to your computer a user ID. Vino-Say may use activity tracking from users activity on the app.
9. REVIEWS
9.1. Vino-Say App makes use of a “Review” functionality whereby users of the App may write and publish their review/s of Wine Merchant products and which will be visible to view by other users and Wine Merchants.
10. SECURITY OF YOUR PERSONAL INFORMATION
10.1. The security of your Personal Information is important to us. We follow generally accepted industry standards to help protect your Personal Information including without limitation:
10.1.1. limiting access to your Personal Information to those of our employees who require it to provide services to you;
10.1.2. requiring employees to sign confidentiality agreements to protect customer and other confidential information;
10.1.3. ensuring that third party service providers sign confidentiality agreements to maintain the confidentiality of your Personal Information and not to use it for any unauthorized purposes;
10.1.4. Personal Information collected is retained as long as it is reasonably required for the purposes it was collected;
10.1.5. storing your Personal Information in secure computer systems which protect it from unauthorised access or use.
10.2. Whilst we will do all things reasonably necessary to protect your rights of privacy, we cannot guarantee or accept any liability whatsoever for unauthorised or unlawful disclosures of your Personal Information, whilst in our possession, made by third parties who are not subject to our control, unless such disclosure is as a result of our gross negligence.
10.3. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to protect your Personal Information, we cannot guarantee its absolute security.
10.4. If a password is used to protect your account and Personal Information, it is your responsibility to keep your password confidential.
11. CHILDREN
We do not intend to solicit or collect Personal Information from anyone who has not reached majority status in the jurisdiction in which you reside. If you are not of majority status you shall not use or enter information on the Website. The Platform is intended for use by adults of legal drinking age. If we receive notice or reasonably believe that someone not of majority status has provided us with personal information, we will promptly delete the account and all personal information that has been provided to us.

We assume no responsibility for the policies or practices of such linked sites, and encourage you to become acquainted with them prior to use.
